Room Rental

This is your monthly room rental bill, which covers the cost of utilities including electricity, gas, internet, water, and sewer services. Please note that any additional charges beyond these standard services, such as excess utility usage or special requests, may apply and will be billed separately as needed.

This agreement is in regards to ONE (1) office space in the basement of the building. The extent of this agreement is detailed below in order to define the overall rights, duties, responsibilities, and liabilities concerning such a rental.
The above-mentioned parties agree as follows:
I. DEMISE AND DESCRIPTION OF PREMISES
Elephat hereby leases to the Tenant(s) a ROOM (elephat
II. ) located in 1285 W. King St.). Said rooms will be hereafter referred to as the Premises.
III. TERM
The term of this lease shall month to months(or 12 month subscription), commencing on the 1st day of Payment, and terminating on the 30th day of Month Started, at which point we will re-evaluate the availability of the office space, if needed. Shall the Tenants wish to terminate this agreement sooner, a verbal and written notice must be given no later than 1 weeks prior to termination. Failure to do so may result retraction of the security deposit (you paid $200), contingent upon what steps must be taken to restore the building/office space to its original state prior to the rental.
IV. RENT
During the term of this Lease, Tenant(s) shall pay to Elephat rental of month to month, payable in advance due on the 1st day of each month. We will allow a grace period of tenth (10) days to submit your payment without accruing any fees; office rent is to be paid by the 10th of the month at 11:59:59 PM.
Failure to submit your payment within the grace period allotted will result in an initial late fee of $50 being applied to your past due balance. If payment is still not received by the 21st of the month, a secondary late fee of $50 will be applied to your past due balance. If no payment has been made by the final day of the month, a tertiary late fee of $100 will be applied to your past due balance. This cumulated total will be due by the end of grace period of the approaching month. After two (2) or more late rent payments, we reserve the right to reevaluate or terminate this rental agreement. Consecutive late payments will not be tolerated.
Please submit your payments via cash, check, or Venmo. Checks shall be made payable to Elephat Printing & Design and can be mailed into the shop or given directly to Romy Aure, or sent via Invoice or cash. Be sure to include the month(s) that you are paying for in the “memo” of your payment.
V. USE OF PREMISES
The Premises is to be used for the purposes of music production. Lessees shall restrict its use to such purposes and shall not use or permit the use of the Premises for any other purpose without the prior, express, and written consent of Lessor. Excessive parties are NOT permitted. The attendance of those that are not absolutely necessary to the purposes as specified above should be re-evaluated.
VI. LESSEE’S COVENANTS
The Lessee covenants with the Lessor as follows:
a. TO PAY RENT
To pay the rent at the times and in the manner set forth above in Section III. Failure to do so may result in termination of this rental agreement.
b. TO OBTAIN RENTERS INSURANCE
To apply for renter’s insurance in order to insure all items within the premises. In the event of a disturbance or natural disaster resulting in property loss or damage, Elephat Production & Design, LLC. is not liable for said damages. It is the responsibility the tenant to obtain and maintain coverage. If you do not wish to obtain coverage at this time, that is your choice and your risk.
c. PARKING
To only occupy 1 (ONE) of the off-street parking spaces at a time within the operating hours of the business. Beyond 5pm, the parking lot is available so long as it is cleared by 5am. (In the event of inclement weather, the lot must be vacant by morning, or your car may be shoveled in or towed.)
d. ADDITIONS AND ALTERATIONS
Not to make or suffer any additions of alterations in or to Premises without the written consent of the Lessor.
**We approve the installation of equipment and materials needed to create/produce music and to improve sound quality of the Premises.
e. CLEANLINESS/WASTE
Not to make or suffer any waste of the Premises, and to maintain cleanliness of all common areas (conference room area, ‘kitchen’ area, and all bathrooms). These common areas are to be kept in neat and tidy order AT ALL TIMES. This includes wiping surfaces after eating, vacuuming messes as they occur, and sweeping/mopping and general cleaning of the bathrooms as needed. Vandalism of any kind will NOT be permitted. This includes, but is not limited to tagging, graffiti, or any other unauthorized addition to any surface within/outside of our building. Any and all damages will result in fees for these damages being added to your rent for the following month. You are responsible for the individuals you bring into this building; please express this to them.
f. SIGN, ETC.
Not to suffer any holes to be drilled or made in the stone or brick work, nor any placard to be placed on the outer wall, nor any signs to be on the Premises, except such as the Lessor shall approve, and then only in such place and so affixed as the Lessor shall prescribe.
g. IMPROPER USE
Not to make or suffer any unlawful, improper, or offensive use of the Premises, nor any use of the Premises other than the business purpose specified in Section IV. This includes any excessive or unauthorized gatherings or parties. Excessive traffic between the hours of 12AM (midnight) and 5AM is NOT PERMITTED. Only individuals pertinent to the business purpose(s) as specified in Section IV are permitted during odd hours. We are a part of this neighborhood and we need to respect it.
h. TO CONFORM TO REGULATIONS
To conform to such reasonable regulations as may be established from time to time by the Lessor for the general convenience of the building. Please come to us with any issues, questions, or concerns as they arise so we may properly address them.
i. NOT TO INCREASE INSURANCE RATE
Not to suffer to be upon the Premises any trade or business, or anything to be done on the Premises, which would increase the rate of premiums for insurance upon the building or its contents.
j. WATER OR OTHER DAMAGE TO PROPERTY
The Lessor shall not be liable for any damage or injury by water, fire or otherwise to any merchandise or property upon the Premises.
k. TO PERMIT LESSOR TO ENTER
To permit the Lessor at all reasonable times to enter upon and examine the Premises and make such repairs as it may think necessary for the protection of the Premises. Lessee must provide a spare key for room access in the event of an emergency or required maintenance.
l. TO YIELD UP IN GOOD REPAIR
At the end of the term peaceable to deliver up to the Lessor the Premises, with all future productions or additions upon or to the same, in good repair, and vacant and unencumbered, and in good and tenantable order and condition.
m. TO REPLACE ANY CONVENIENCE ITEMS USED
Food and drink items belong to someone. Items not included in the list on the fridge are off limits. Please do not ingest without sending compensation for the amount on the sticker, or exact replacement of the item(s).
VII. LESSOR’S COVENANTS
The Lessor covenants with the Lessee as follows:
a. QUIET ENJOYMENT
The Lessee shall peaceably hold and enjoy the Premises without hindrance on the part of the Lessor.
b. HEAT
During business hours, except in case of unavoidable accident, Premises shall be kept adequately heated.
c. BREAKROOM ACCESS
The Lessee shall have access to the kitchen/conference room areas. These areas may also be reserved, if available, with a written request. Keep clean at all times
d. BACK AREA
Back area is for elephat supplies and if used rent may go up. Please keep all areas cleaned and organized.

e. Bathrooms
Cleaned up after each client and or person. Failure to do so there will be a $50 weekly cleaning charge ( charged as Chrissy Cleaning Service LLC)
Trash taken out at end of week back area (all areas used )

VIII. EXPIRATION/TERMINATION
Upon expiration or termination of this lease, Lessee shall return the property to Lessor in substantially the same condition in which the property was received by Lessee.

By signing this document, Lessee(s) and Elephat Production & Design, LLC. covenant, understand, and agree to be liable under the terms of this agreement, and hereby agree to perform all of the covenants and undertakings herein contained to be kept.
